General Terms and Conditions for Purchases on Virunga Mountain Spirits Ltd website
Disclaimer: You must be 21 years of age or older to place an order on our website. By agreeing to these terms and conditions, You confirm that You meet this age requirement.
1. Introduction
This outlines the terms and conditions associated with using this website for the purchase of products by customers and visitors who do not make any purchases (hereinafter referred to as “Customers” or “You”) from Virunga Mountain Spirits Ltd (“VMS”)
By accessing or using the Site, You agree to be fully bound by these Terms. Please review these Terms carefully. We assume no responsibility for any misunderstanding of these Terms; however, VMS is available to provide clarification on any part of these Terms.

2. The Products
VMS offers tour and tasting experiences and operates a full-service grill, with booking through its online ‘store’. The online store also offers a selection of premium locally-made spirits, VMS merchandise, as well as locally-crafted artisan products from skilled artisans (collectively referred to as the 'Products'). Customers can place orders for Products through VMS's website using any device. Delivery times solely depend on the customer's location, and an estimated arrival date is provided at the time the order is placed.
To complete a purchase, customers may be required to provide certain information, including, but not limited to, full names, telephone numbers, email addresses, and country of residence. The handling of such information is governed by the 'Data Privacy' section of these Terms.
3. Exclusion of Liability
VMS shall not be liable for any consequences that may arise from a Customer’s use of Products purchased from the site. The Customer is solely responsible for conducting any necessary research to ensure that the Products purchased are suitable for their needs. Additionally, VMS shall not be held responsible for any loss or damage of any kind resulting from, or caused by, the loss, unauthorized use, sale, or manufacture of the Product.
4. Update of Terms
The Terms are subject to change at the discretion of VMS. VMS will notify users of any updates to these Terms and Conditions by posting a notice on the website. The updated Terms will become effective upon being posted on the site, and continued use of the site by Customers and visitors will constitute formal acceptance of the new Terms. VMS will not be liable for any individual’s failure to be aware of or correctly interpreting the updated Terms.
5. Pricing
The prices for each Product are stated on the sections of the Site where the relevant Product is featured. These prices are fixed and non-negotiable. To ensure You are viewing the most up-to-date pricing and availability, please refresh your screen regularly.
6. Data Privacy
VMS shall safeguard the privacy of Customers and visitors to the site, maintaining confidentiality of all site visits, information requests, site usage, and Product purchases. However, VMS will collect information from Customers and visitors for various purposes, including maintaining records and enhancing the online experience, as well as sharing data with affiliated third parties when, for example, product delivery is requested. You warrant that any personal data You submit is accurate and complete, and You consent to and authorize VMS to process your personal data.
VMS shall not provide such information to any third party except to a Government authority if required by Rwandan law, and only to the extent requested by the relevant authority.
By using our site and accepting these Terms and Conditions, You consent to receive communications from VMS via SMS, email, and in-app notifications, including order summaries and delivery updates. You may opt out at any time.
7. Intellectual Property
VMS shall retain ownership of all logos, brands, slogans, and content posted on the site. Such intellectual property may not be used by third parties without VMS’s permission. Except as explicitly allowed on this site or in writing by VMS, any reproduction, distribution, replication, or retransmission of any information, data, text, illustrations, images, photographs, videos, audio sequences, logos, or code contained on this site without prior written consent from VMS is strictly prohibited.
8. Code of Conduct
You may not use this site or any material appearing on it for any illegal, unlawful, or immoral purposes, or in any manner prohibited by these Terms and Conditions. You warrant that You will comply with all applicable laws, rules, and regulations governing online conduct in Rwanda.
9. Cancellation and Returns Policy
An item in the cart may be canceled at any time before payment is processed. Once payment has been completed, the Product is deemed purchased.
If You are dissatisfied with a Product, You may return it within 24 hours of delivery. Returns are not accepted after this 24-hour period. Upon receiving the returned item, VMS will verify its condition to ensure it matches the original product sent. A refund will be processed based on this verification.
Cancellation of pre-booked tours or meal reservations will be refunded only if received at least 24 hours in advance.
10. Protection of Personal Data
VMS, as your Data Controller, is committed to implementing all reasonable technical and organizational measures to safeguard your personal data against loss, misuse, or alteration. However, You acknowledge that transmitting information over the internet is inherently insecure, and VMS cannot ensure complete security of data transmitted online.
11. Complaint Handling Procedure
If You have any issues or complaints related to these Terms and Conditions, the use of our website or the purchased Products, please follow the steps outlined below to initiate the complaint resolution process:

Submission of Complaint:
Clearly describe the nature of your complaint, providing specific details and supporting evidence if available. And submit your complaint via email or mail to the contact information provided above.
Acknowledgment: We will acknowledge receipt of your complaint within 5 business days following reception.
Investigation: Our team will thoroughly investigate the complaint, considering all relevant information and ensuring compliance with our policies.
Resolution: We will aim to resolve the complaint promptly and communicate to You within 15 calendar days from the date of acknowledgment.
12. Applicable Law and Dispute resolution
These Terms shall be construed, governed, and interpreted in accordance with the laws of the Republic of Rwanda.
The parties agree to make every effort to resolve amicably any disputes arising from or related to these Terms using the Complaint Handling Procedure outlined in Point 11 above.
Should any dispute not be resolved through the complaint handling procedure, it may be submitted to arbitration under the rules of the Kigali International Arbitration Centre (KIAC). The arbitration will be conducted by a Sole International Arbitrator appointed by KIAC. The place of arbitration will be Kigali, and the language of the arbitration will be English.
